(Published In THE TIMES, Mayes County, Oklahoma December 24, 31, 2015) NOTICE OF ELECTION Under and by virtue of Title 68, Oklahoma Statues 2011, Section 1370, and the Order of the Board of County Commissioners of Mayes County, Oklahoma, authorizing the calling of an election for the purpose hereinafter set forth, approved the 9thday of November, 2015, I, the undersigned, Chairman of said Board of County Commissioners of said County, hereby call an election to be held in said County on the 12thday of January, 2016, for the purpose of submitting to the registered, qualified taxpaying voters of said County the following Proposition. PROPOSITION NO. 1 SHALL THE COUNTY OF MAYES, STATE OF OKLAHOMA, BE AUTHORIZED TO LEVY AND ASSESS A COUNTY EXCISE (SALES TAX) OF THREE-SIXTEENTHS OF ONE PERCENT (0.1875%), WHICH SHALL REPLACE THE THREE-EIGHTHS OF ONE PERCENT (0.375%) ENACTED BY RESOLUTION NO. 2001-70, DATED DECEMBER 7, 2001, USED TO PAY DEBT SERVICE ON INDEBTEDNESS INCURRED TO ACQUIRE, CONSTRUCT AND EQUIP THE COUNTY COURTHOUSE FACILITY ON THE PAYMENT IN FULL OF SAID INDEBTEDNESS, IN ADDITION TO ALL OTHER TOWN, COUNTY AND STATE EXCISE TAXES LEVIED OR ASSESSED, UPON THE GROSS PROCEEDS OR GROSS RECEIPTS DERIVED FROM ALL SALES TO ANY PERSON TAXABLE UNDER THE SALES TAX LAW OF OKLAHOMA AS SET OUT IN RESOLUTION NO. 2015-89 OF THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF MAYES; SAID SALES TAX REVENUES THEREFROM SHALL BE USED TO PAY DEBT SERVICE ON BONDS OR NOTES ISSUED BY THE MAYES COUNTY PUBLIC FACILITIES AUTHORITY, THE PROCEEDS OF WHICH ARE TO BE USED TO ACQUIRE, CONSTRUCT, EQUIP AND REMODEL THE COUNTY FAIRGROUNDS FACILITIES, WITH SAID THREE-SIXTEENTHS (3/16) OF ONE PERCENT (0.1875%) TO TERMINATE AT THE EARLIEST POSSIBLE DATE THAT SAID SALES TAX REVENUES ARE SUFFICIENT TO RETIRE SAID BONDS OR NOTES, ALL AS SET FORTH IN SAID RESOLUTION NO. 2015-89, A COPY OF WHICH IS ON FILE WITH THE COUNTY CLERK OF THE COUNTY OF MAYES? The ballot used at said election shall set out the Proposition as above set forth, and shall also contain the words: Yes - For the above Proposition No - the above Proposition PROPOSITION NO. 2 SHALL THE COUNTY OF MAYES, STATE OF OKLAHOMA, BE AUTHORIZED TO LEVY AND ASSESS A COUNTY EXCISE (SALES TAX) OF ONE-SIXTEENTH OF ONE PERCENT (0.0625%), WHICH SHALL REPLACE THE THREE-EIGHTHS OF ONE PERCENT (0.375%) ENACTED BY RESOLUTION NO. 2001-70, DATED DECEMBER 7, 2001, USED TO PAY DEBT SERVICE ON INDEBTEDNESS INCURRED TO ACQUIRE, CONSTRUCT AND EQUIP THE COUNTY COURTHOUSE FACILITY ON THE PAYMENT IN FULL OF SAID INDEBTEDNESS, IN ADDITION TO ALL OTHER TOWN, COUNTY AND STATE EXCISE TAXES LEVIED OR ASSESSED, UPON THE GROSS PROCEEDS OR GROSS RECEIPTS DERIVED FROM ALL SALES TO ANY PERSON TAXABLE UNDER THE SALES TAX LAW OF OKLAHOMA AS SET OUT IN RESOLUTION NO. 2015-89 OF THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF MAYES; SAID SALES TAX REVENUES THEREFROM SHALL BE USED TO PAY OPERATION AND MAINTENANCE ON ALL COUNTY BUILDINGS, ALL AS SET FORTH IN SAID RESOLUTION NO. 2015-89, A COPY OF WHICH IS ON FILE WITH THE COUNTY CLERK OF THE COUNTY OF MAYES? The ballot used at said election shall set out the Proposition as above set forth, and shall also contain the words: Yes - For the above Proposition No - the above Proposition Said election shall be conducted in all of the regular voting places established by the Mayes County Election Board and conducted by the regular precinct officers appointed by said County election Board for the purpose of conducting other county-wide elections.
